Terms of Service

These Terms govern your use of the Mozomay platform and services. By subscribing to or using Mozomay, you agree to them. Please read them alongside our Privacy Policy and Cookie Policy.

1. Who we are

Mozomay is provided by Mozomay Ltd, a company registered in England and Wales under company number 17318563, registered office 128 City Road, London, EC1V 2NX, United Kingdom. "We", "us" and "our" mean Mozomay Ltd. "You" and "your" mean the business that subscribes to the service.

2. The service

Mozomay is cloud-based software for managing a garage or bodyshop's jobs, estimates, parts, invoicing and reporting. We offer:

  • Mozomay Workflow: the core job-management platform. £189 per month, with no setup fee.
  • Mozomay OS: Workflow plus a done-for-you website with an integrated quote form. £259 per month plus a one-off £499 setup fee.

Prices are in GBP and exclude VAT where applicable. We may change our prices on notice. Any change will not affect your existing subscription rate during a billing period, and where we have offered you a rate "locked for life" we will honour that for the lifetime of your account.

3. Subscriptions, billing and renewal

  • Subscriptions are billed monthly in advance and renew automatically each month until cancelled.
  • Payment is taken by our payment provider, Stripe. By subscribing you authorise recurring charges to your chosen payment method.
  • If a payment fails, we may retry it and will contact you. We may suspend access to the service if payment remains outstanding.
  • The £499 Mozomay OS setup fee is a one-off charge taken at the start of a Mozomay OS subscription.

4. Cancellation and refunds

You can cancel at any time. There are no fixed-term contracts. To cancel, email lawand@mozomay.com or use the cancel option in your billing area.

  • Cancel before your workspace goes live: you receive a full refund and your subscription is cancelled.
  • Cancel after your workspace is live: we stop all future billing immediately. The current month is not refunded, and you keep full access until the end of your paid period.
  • After cancellation we retain your data for 30 days in case you return, then permanently delete it. You can ask us for an export of your job data at any time.

5. Your responsibilities

You agree to provide accurate account information, keep your login credentials secure, use the service lawfully, and ensure that you have the right to upload any data, including your customers' personal data and vehicle or damage photos, into Mozomay. You are responsible for activity that happens under your account.

6. Acceptable use

You must not misuse the service. This includes attempting to gain unauthorised access, disrupting the platform, reverse-engineering it, reselling it without our agreement, or using it to store unlawful content. We may suspend or terminate accounts that breach these Terms.

7. Your data and ownership

  • Your data is yours. You retain all rights to the data you and your customers put into Mozomay. We claim no ownership of it.
  • We process that data only to provide and improve the service, as set out in our Privacy Policy. For the personal data of your customers, you are the data controller and we act as your data processor.
  • We will not sell your data or your customers' data.

8. Mozomay OS websites and "Powered by Mozomay"

For Mozomay OS customers, we build, host and maintain your website. Every page carries a "Powered by Mozomay" credit, which is a standard part of the Mozomay OS service. The website and quote form remain part of the service we provide. On cancellation, the hosted website and quote form are deactivated. Full Mozomay OS terms are set out in the Schedule below.

9. Availability

We work to keep Mozomay available and reliable but do not guarantee uninterrupted service. We may carry out maintenance and will aim to minimise disruption. We are not liable for downtime caused by factors outside our reasonable control.

10. Liability

Nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or fraud. Subject to that, and to the fullest extent permitted by law, we provide the service "as is". We are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill. Our total liability to you in any 12-month period is limited to the fees you paid us in that period. As Mozomay is supplied to businesses, the consumer-protection rules that apply to consumers do not apply to this agreement.

11. Termination

You may cancel as set out in clause 4. We may suspend or end your access if you materially breach these Terms or fail to pay. On termination, clause 4's data-retention terms apply.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and, for material changes, let you know by email. Continuing to use Mozomay after a change means you accept it.

13. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

14. Data Processing Agreement

Where we process personal data on your behalf, for example the personal data of your customers that you enter into Mozomay, our Data Processing Agreement forms part of, and is incorporated into, these Terms. In the event of a conflict on data-protection matters, the Data Processing Agreement prevails.
